Appeal Process
Any person aggrieved by the decision of the Authority as envisaged under this Rule(CT -Procedure rules 2017), shall file a Notice of Appeal in Form CT4; within 14 days of receiving the decision; and Memorandum of Appeal in Form CT5 respectively within thirty days from the date of receipt or notification of the decision of the Authority.
The Memorandum of Appeal shall be accompanied by the following documents:
The appellant shall serve the respondents within 14 days after filing the appeal.
Respondents must file a replying affidavit within 14 days of service.
Respondent may file a Cross-Appeal in Form CT6 as prescribed in the First Schedule within fourteen days from the date of service. The Cross-Appeal shall be accompanied by the following documents:
Fourteen days after the filing of the replying affidavit by the Respondent or the affidavit by the enjoined party, no further pleadings shall be filed without leave of the Tribunal upon such terms as it deems fit.
